Introduction
Every year, a large number of taxpayers in India realise — often weeks after the deadline — that their income tax return was never filed. Work got busy, Form 16 arrived late, a capital gains statement was missing, or the return was simply forgotten. If that is your situation, the important thing to know is this: missing the original due date does not necessarily mean you have lost the opportunity to file.
The Income-tax Act allows eligible taxpayers to file what is known as a belated return — a return filed after the original statutory due date but within the further time permitted by law. It is a valid return. It can generally be used to report your income, pay any balance tax and, where applicable, claim a refund.
The catch is that a delay is not free. A late filing fee may apply, interest may accrue where tax remains payable, refunds get delayed, and the ability to carry forward certain losses may be affected. That is why the practical advice is simple: if your return is pending, file it as soon as you reasonably can rather than letting it sit. An unfiled return does not quietly go away — it tends to resurface as a notice, a blocked refund or a documentation problem when you apply for a loan or a visa.
What is a belated income tax return?
A belated return is an income tax return filed after the original due date prescribed under the Income-tax Act, but within the additional time that the law permits for that assessment year. In plain terms, it is the same ITR you would have filed on time — filed late, with the delay disclosed and the applicable fee and interest, if any, paid along with it.
Filing a belated return is a normal, legitimate compliance step. It is not an admission of wrongdoing, and it is very common: salaried taxpayers who changed jobs mid-year, freelancers waiting on Form 26AS reconciliation, and small business owners closing their books late all end up here.

Can I still file my ITR after the due date?
Yes — eligible taxpayers can generally file a belated return within the permitted time.
The applicable deadline depends on the relevant assessment year and the tax law prevailing at that time. You cannot assume the same cut-off applies to every year — each assessment year has its own window.
For AY 2026-27, the belated return deadline is generally 31 December 2026, subject to applicable law.

What happens if you file your ITR late?
Filing late is better than not filing at all, but there are consequences you should plan for. The exact impact depends on your income, the tax already paid and your individual facts.
Applicable late filing fee
A fee under section 234F may apply where the return is filed after the due date. The amount varies with total income and applicable provisions.
Interest for delay, wherever applicable
Where tax remains payable, interest under sections 234A, 234B and 234C may apply and continues to accrue until the liability is cleared.
Delay in receiving certain refunds
Refund processing generally begins only after the return is filed and e-verified, so a late return means a later refund.
Impact on carrying forward certain losses
Carry forward of business loss and capital loss is generally not permitted where the return is filed after the due date. Treatment varies by type of loss.
Consequences where tax remains payable
An outstanding liability that stays unpaid may attract further consequences under applicable provisions, including demand and recovery proceedings.
Additional compliance issues
Pending returns can complicate loan applications, visa documentation, tender submissions and responses to departmental notices.
Late filing fee
Where a return is furnished after the due date, a late filing fee under section 234F of the Income-tax Act may apply. The law provides a lower fee for taxpayers whose total income is below a specified threshold and a higher fee for others. In addition, where tax is still payable, interest under section 234A may apply for the period of delay, and interest under sections 234B and 234C may apply in relation to advance tax.
It is important not to work off a single flat figure you read somewhere. Whether any fee applies at all, and how much, depends on facts such as your total income, whether you were required to file, the tax already deducted or paid, and the provisions applicable to your assessment year.
