Everything you need to gather before filing a trademark (word / logo / slogan) application under the Trade Marks Act, 1999 — with MSME / Startup fee benefit of ₹4,500.

- PAN card of applicant (individual / proprietor / company / LLP / partnership)
- Aadhaar card / passport / driving licence of the signatory
- Address proof — utility bill, passport, bank statement (not older than 2 months)
- Passport-size photograph of the applicant / authorised signatory
- Email ID and active mobile number for TM portal OTP
Business / Entity Proof
- GST certificate or Udyam (MSME) certificate (for startup 50% fee benefit)
- Certificate of Incorporation / LLP Agreement / Partnership Deed
- Board Resolution authorising the signatory (for companies & LLPs)
- For proprietorship — GST / Udyam / shop & establishment certificate
Trademark Details
- Exact word / logo / slogan you want to register (JPG/PNG, min 300 DPI, max 2 MB)
- Class of goods or services (NICE Classification 1–45) — choose correct class
- Description of goods / services (short, specific — no vague terms)
- Date of first use in India (if already used) — with proof (invoice, ad, packaging)
- If no prior use — mark as ‘Proposed to be used’
Authorisation & Filing
- Form TM-48 — Power of Attorney in favour of trademark attorney (₹100 stamp)
- MSME / Startup India certificate — for reduced government fee of ₹4,500
- Priority document (if claiming Convention application under Paris Convention)
- User affidavit (only if claiming prior use — with supporting evidence)
Pre-Filing Public Search (must do)
- Public search on ipindiaonline.gov.in — verify no identical / deceptively similar mark
- Check Wordmark + Phonetic + Vienna Code (for device / logo) searches
- Review last 6 months of Trademark Journal for pending oppositions
- Shortlist backup classes if primary class shows conflict
